On March 29, USCIS announced the expansion of premium processing to additional classifications and categories of forms to address processing backlogs.
Prior to this expansion, premium processing was only available for employers filing Form I-129, Petition for a Nonimmigrant Worker and certain employment-based categories of Form I-140, Immigrant Petition for Alien Worker.
With the expansion, premium processing will also be available for Form I-539, Application to Extend/Change Nonimmigrant Status; Form I-765, Application for Employment Authorization; and additional classifications under Form I-140. Please note that although the new rule is in effect, only some of the above forms are eligible for premium processing today and USCIS will implement the expansion in phases over the next three years.
